Refus du Juge Dembe concernant la demande de Mumia

Le Juge d'État de Pennsylvanie Pamela Dembe a décrété aujourd'hui que le cas de Mumia Abu-Jamal ne dépendait pas de sa juridiction. Autrement dit, elle n'a pas l'intention de re-ouvrir les Post Conviction Relief Act hearings (auditions post-condamnations) comme l'avait demandé Mumia. Il est possible de faire appel de la décision du juge Dembe auprès de la Cour suprême de Pennsylvanie.

En attendant, toute la pression doit être dirigée vers le Juge Fédéral Yohn puisqu'il a la possibilité de prendre une décision à tout moment. Nous voulons que le Juge Yohn prenne acte des nouvelles preuves que Mumia a soumis - en particulier la confession d'Arnold Beverly (qui a avoué le meurtre de William Faulkner, meurtre pour lequel Mumia a été condamné à mort) et toutes les nouvelles déclarations sur l'honneur.

Nous supposons qu'avec la récente publication de la letttre de l'Assn d'Avocats Démocratiques Int'l, la prochaine conférence de presse du 7 décembre à Philadelphie avec Angela Davis, une délégation française et autres, la manifestation prévue le 8 décembre à Philadelphie et le soutien grandissant à l'innocence de Mumia, l'appareil judiciaire et policier de Philadelphie est sur la défensive.

La manifestation de masse prévue à Philadelphie le 8 décembre est maintenant plus importante que jamais! Nous devons mobiliser l'opinion publique sur le fait que les systèmes juridique-accusatoire et policier cherchent à tuer un homme innocent - et à empêcher au tueur avoué d'apporter son témoignage!

 

More on Judge Dembe's Denial of MUMIA

Pennsylvania State Judge Pamela Dembe has just ruled today that she has no jurisdiction over Mumia Abu-Jamal's case at this state in the legal proceedings. In other words, she will not re-open the Post Conviction Relief Act hearings as Mumia has requested her to do. Judge Dembe's ruling can be appealed in the Pennsylvania State Supreme Court. (Her ruling will be posted
online by Fri. the 23rd).

In the meantime, all pressure should be directed toward Federal Judge Yohn since he too is in a position to make a ruling at any time now. We want Judge Yohn to hear the new evidence that Mumia has submitted -- in particular the confession of Arnold Beverly (confessed to the cop killing that Mumia was framed up and on death row for) and all the substantiating affidavits.

With the recent publication of the Assn of Int'l Democratic Lawyers letter, the upcoming press conference on Dec. 7th in Philadelphia with Angela Davis, a French delegation and others, the scheduled demonstration on Dec. 8th in Philadelphia, and mounting support for Mumia's innocence, we believe that the Philadelphia judicial, prosecutorial and police systems are on the defensive.

The mass demonstration scheduled for Philadelphia for Dec. 8th is now more important that ever! We must mobilize public opinion that the judicial-prosecutorial and police systems in this country are seeking to kill an innocent man -- to not even allow the confessed, real killer to testify!
